1. Who we are
Pulse is a trading name of Ryan Eoin Keane, a sole trader based in the United Kingdom ("Pulse", "we", "us"). When you use Pulse you are contracting with Ryan Eoin Keane trading as Pulse.
2. Acceptance
By creating an account or continuing to use Pulse, you agree to these terms. If you use Pulse for an organisation, you confirm you have authority to bind it. Individuals must be at least 18.
3. The service
Pulse is an online tool that uses artificial intelligence to analyse customer feedback you provide, classifying sentiment, themes and urgency. We grant you a limited, non-exclusive, non-transferable right to use Pulse within your selected plan.
4. Your account
Keep your login details confidential; you are responsible for activity under your account. Provide accurate information and keep it up to date.
5. Acceptable use
You must not misuse Pulse, including by:
- using it unlawfully, for fraud or for spam;
- uploading content that infringes others' intellectual property or privacy, or that is illegal, hateful or harassing;
- interfering with security — malware, probing, scraping, or attempting to bypass limits or safeguards (including "jailbreaking" the AI);
- reverse engineering, reselling or redistributing the service.
6. Your content and AI outputs
You keep ownership of the feedback you upload and the results Pulse generates for you. You confirm you have the right to upload that content, and you grant us a limited licence to host and process it solely to provide the service. You are responsible for how you use outputs.
AI outputs may be inaccurate or incomplete. Check important results before acting on them; Pulse is not a substitute for professional advice. We may remove or restrict content, filter outputs, or suspend accounts that breach these terms. Rights-holders can report infringing content to us via the contact form on our home page; repeated infringement leads to account termination.
7. Intellectual property
We own Pulse and all related intellectual property, including the software, documentation and branding.
8. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, renewal, tax, cancellation and refund terms are governed by Paddle's Buyer Terms. Plans renew monthly until cancelled; paid plans start with a 14-day free trial. See our Refund Policy.
9. Service level
We work hard to keep Pulse running, but we do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends you may request an export of your data within 30 days, after which it may be deleted.
11. Liability
Our total liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential losses, including loss of profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law. You indemnify us against claims arising from your content, unlawful use, or breach of these terms.
12. General
We are not responsible for delays caused by events beyond our reasonable control. You may not assign these terms without our consent; we may assign them as part of a sale or transfer of the business. These terms are governed by the laws of England and Wales, and its courts have jurisdiction. We may update these terms and will post changes here.
